Terms & Conditions

Neat Freaks Limited provides its Services to you on the following Terms and Conditions. These Terms and Conditions or Terms Of Service are a legal contract between the individual or company using the Service (“you” or “customer’) and Neat Freaks Limited (“Company,” “we,” “us,” or “our”). The term, “Site” will henceforth refer to the website operated by the Company and found on the internet; www.neatfreaks.co.nz. The Site may be updated, relocated, or modified from time to time, and includes any and all information in the form of text, images, and other materials and content appearing on or forming any part of this website. The terms “Neat Freaks” or “Service” mean the Site, and the products and/or services offered, owned or operated by the Company.

1. Terms of Service
You acknowledge that you have read and understood the Neat Freaks Terms and Conditions and agree to abide by them when you:

  • i. access/click on our website/browse through our website pages
  • ii. contact us to provide you with our Services
  • iii. use our Service/s

2.Free Quotation
Any quotation obtained online or through a company representative is only an estimate. The actual charge/cost will be determined by the amount of time (rounded to the nearest 15 minutes) required to finish providing Services to you according to your requirements.

3.Payment Terms

Residential:

  • i. An invoice will be emailed on the scheduled day of Service/s detailing all monies owed to Neat Freaks.
  • ii. Payment for Services must be made no longer than 24 hours after the scheduled provision of Service/s.
  • iii. No further Services will be provided until any outstanding payment is made in full.
  • iv. Outstanding payments will be referred to a debt collector if not paid in full within 30 days of an invoice being issued.

Commercial:

  • i. An invoice will be emailed at the end of the calendar month for any Service/s provided during the month detailing all monies owed to Neat Freaks.
  • ii. Payment for Services must be made no longer than 15 days after an invoice is issued.
  • iii. No further Services will be provided until any outstanding payment is made in full.
  • iv. Outstanding payments will be referred to a debt collector if not paid in full within 30 days of an invoice being issued.
  • v. Directors/Owners of a business or organisation are directly responsible for any outstanding monies owing to Neat Freaks even if the client business or organisation is about to go or already gone into liquidation.

The Company may update Pricing Schedule from time to time on a going-forward basis. The Company reserves the right to determine final prevailing pricing – please note the pricing information on the website may not reflect the final price charged for Services. We encourage you to keep checking back on our website to find out about any periodic price changes.

4.Disputes

  • i. Any disputes regarding the provision of Services must be made by contacting Neat Freaks in writing at info@neatfreaks.co.nz within 48 hours of the Service occurring/being provided. Neat Freaks will try to remedy disputes on a case by case basis.
  • ii. Any disputes regarding any invoice must be submitted to Neat Freaks in writing at info@neatfreaks.co.nz within 5 days of the invoice being issued.

5.Rescheduling Policy

Residential Services:

  • i. You may reschedule a one-off Service any time by providing a minimum of 24 hours of notice before your scheduled Service. Any rescheduling done by providing less than 24 hours of notice, will incur 50% of the charge of the original scheduled Service in addition to the charge of the rescheduled Service.
  • ii. Any recurring Services can only be rescheduled to a different day of the same week.
  • iii. Any rescheduled Service will be determined by availability of a different time and date to provide the Service.
  • iv. All rescheduled Services will incur a $10 rescheduling fee.

Commercial Services:

  • i. You may reschedule a one-off Service any time by providing a minimum of 24 hours of notice before your scheduled Service. Any rescheduling done by providing less than 24 hours of notice, will incur 50% of the charge of the original scheduled Service in addition to the charge of the rescheduled Service.
  • ii. Any recurring Services can only be rescheduled to a different day of the same week.
  • iii. No rescheduling may be done if Services are being provided every day of the week.
  • iv. Any rescheduled Service will be determined by availability of a different time and date to provide the Service.
  • v. All rescheduled Services will incur a $10 rescheduling fee.

6.Cancellation and Refund Policy

Notification of cancellation must be by email to info@neatfreaks.co.nz.

  • i. Any fees which the Company may charge you for a Service prior to the Service being performed may not be refundable.
  • ii. You may cancel your scheduled Service at any time by providing a minimum of 24 hours of notice.
  • iii. Any cancellation or re-scheduling done by providing less than 24 hours of notice will incur the full charge of the scheduled Service.

7.Recurring Service

For a recurring Service, a customer subscribes for a defined period of time for recurring provision of Service/s with the company. Recurring Service/s can be subscribed for on a weekly, fortnightly or monthly basis only.

Residential Services:

  • i. A customer is free at any time to cancel their Service. Our standard Cancellation Policy applies.

Commercial Services:

  • i. A customer is free at any time to cancel their Service by giving a minimum notice period of 60 days. A termination fee of $1000 applies when a minimum notice period of 60 days is not given.

8.Health & Safety

All hazards or potential hazards on premises where Service/s are to be provided should be reported to the Company before commencement of Service/s.

Immediate Danger or Serious Risk:

  • i. Immediate Danger or Serious Risk will be defined as any object, behaviour or operation that can cause serious harm or result in a notifiable injury as defined by the Health and Safety At Work Act 2015.
  • ii. The Company reserves the right to cancel any Service/s immediately where there is an immediate danger to any Company Employee/Contractor or a serious Health & Safety Risk in any area or premises where Service/s are being provided.
  • iii. Any discontinuation of Service/s based on Immediate Danger or Serious Risk will incur the full charge of the scheduled Service/s.

Safety Concerns or Hazards:

  • i. We may inform you of any Safety Concerns or Hazards that any Company Employee/Contractor observes and request that these be resolved. Failure to do so will result in all or part/s of the Service being omitted.
  • ii. Any omission or partial omission of Service/s due to Safety Concerns or Hazards will still incur the full charge of the scheduled Service/s.

9.Important Cleaning Terms

  • i. Free Clean – refers to cleaning Service/s provided free of charge. A Free Clean may not be rescheduled. A Free Clean will only include a provision of Services for 90 minutes and shall not exceed this time limit under any circumstances. All other standard Terms and Conditions apply to a Free Clean.
  • ii. Free Quotation – refers to the online calculator which determines the cost of Service/s for all Customers, of which the end calculation may be amended at the Company’s sole discretion by a Company representative.
  • iii. Standard Clean – refers to any Regular Cleaning Service where tasks are undertaken according to the ‘Free Quotation’ cost calculator tool.
  • iv. Regular Cleaning Service/s – refers to the specified items of service offered (and as listed on the ‘Free Quotation’ cost calculator) Bedrooms, Bathrooms, Living Rooms/Other, Kitchens, Dishes, Laundry, Inside Cabinets, Inside Fridge, Inside Oven, Interior Windows only.
  • v. Obstructions – refers to any furniture/belongings/items occupying floor space/bench space/furniture surfaces/white ware surfaces. People may also be included as obstructions where their activity/presence in any area or closed space limits our ability to provide our Service to that area/space. We are not obliged to move any ‘obstructions’ when providing our Services and areas where obstructions are present will not be covered by our Services.
  • vi. Vacuum/Vacuuming – refers to spot cleaning (where any dirt is noticed) by vacuuming areas of floor/carpet only. A ‘Full Vacuum’ of the area/property can only be done with a ‘Deep Clean’ but does not include removing or moving any furniture/belongings/items occupying floor space. A ‘Full Vacuum’ does not guarantee a 100% removal of dirt.
    vii. Bedrooms – refers to standard cleaning with the following tasks for bedrooms up to 16 square meters; remove all cobwebs, dust and spot clean surfaces and window sills, clean mirrors, vacuum floor, mop floor (if required).
  • viii. Bathrooms – refers to standard cleaning with the following tasks for rooms up to 8 square meters; remove all cobwebs, dust and spot clean surfaces and window sills, clean mirrors, wipe down (scrub where needed) shower area, shower door, bathtub, sink and all taps, scrub toilet bowl, wipe exterior surfaces of toilet bowl, vacuum floor (if required), mop floor.
  • ix. Toilets – refers to standard cleaning with the following tasks for toilet areas up to 2.8 square meters; remove all cobwebs, dust and spot clean surfaces and window sills, wipe down sink and all taps clean mirrors, scrub toilet bowl, wipe exterior surfaces of toilet bowl, vacuum floor (if required), mop floor.
  • x. Living Rooms/Other Rooms – refers to standard cleaning with the following tasks for rooms up to 35 square meters; remove all cobwebs, dust and spot clean surfaces and window sills, clean mirrors, vacuum floor, mop floor (if required).
  • xi. Kitchens – refers to standard cleaning with the following tasks for kitchens up to 11 square meters; remove cobwebs, dust and spot clean kitchen surfaces and bench top, wipe down taps, clean kitchen sink, clean around stove top, clean top and front of fridge, clean inside and outside of microwave, vacuum floor, mop floor, leave sink and bench top dry. Additional $10 charged if excessive cleaning required inside microwave.
  • xii. Halls/Stairs – refers to standard cleaning with the following tasks for halls/stairs up to 20 square meters; remove cobwebs, dust and spot clean surfaces and window sills, clean mirrors (if any), vacuum floor, mop floor (if required).
  • xiii. Laundry Room – refers to standard cleaning with the following tasks for laundry rooms up to 5 square meters; remove all cobwebs, dust and spot clean surfaces and window sills, clean mirrors, vacuum floor, mop floor (if required).
  • xiv. Dishes (Residential) – refers to standard cleaning of up to 20 dishes, including operating a dishwasher where required. Does not including picking up dishes from around the property.
  • xv. Laundry – refers to putting all items from laundry basket into washing machine, operating washing machine, unloading washing machine and hanging all items to dry (at the designated place, inside or outside). This service is charged per wash load/cycle and may incur additional charges where different wash cycles for different items are required.
  • xvi. Inside Cabinets – refers to wiping all interior surfaces of a cabinet and stain removal where possible by using general natural cleaner only. This may be done by removing shelves where possible. All items must be removed from inside cabinet prior to Service commencing.
  • xvii. Inside Fridge – refers to wiping all interior surfaces of a fridge and stain removal where possible by using general natural cleaner only. This may be done by removing shelves where possible. All items must be removed from inside cabinet prior to Service commencing.
  • xviii. Inside Oven – refers to using a microwave cleaner (chemical based) and wiping away grime from interior walls and racks to whatever extent possible.
  • xix. Interior Windows – refers to cleaning the interior part of windows to a streak free finish (marks/spots removed where possible).
  • xx. Deep Clean – refers to more rigorous and targeted cleaning of any area/property which is unkempt, excessively deteriorating from original condition, contains an excessive amount of dirt/grime/rubbish/mould and is identified by either you or us for the provision of cleaning Service/s. It includes removing marks/stains from surfaces/walls/furniture/white ware where possible unless specifically told to be left alone. Where standard cleaning services are not sufficient to achieve a satisfactory standard of cleaning, a Deep Clean is recommended. A Deep Clean may incur additional costs if additional time is required to complete provision of Service/s and any such additional cost may not be disputed or waived once a Deep Clean request is undertaken and the provision of Service/s has started at the address. Some standard cleaning requests maybe declined or left incomplete unless a Deep Clean is requested. We may at our sole discretion, recommend a Deep Clean prior to, during, or after the provision of standard cleaning Service/s.
  • xxi. Reception Area – refers to carrying out cleaning tasks in the reception/lobby/waiting room of the organisation up to 20 square meters; wiping desks, tables in the reception area that do not have belongings or equipment on it, remove cobwebs, dust and spot clean surfaces and window sills, clean mirrors (if any), vacuum floor, mop floor (if required). Items will not be picked up to clean under.
  • xxii. Dishes (Commercial) – refers to standard cleaning of up to 15 dishes, including operating a dishwasher where required. Picking up dishes from desk spaces will incur an extra charge of $0.20 per desk space.
  • xxiii. Kitchenette – refers to standard cleaning with the following tasks for kitchenettes up to 8 square meters; remove cobwebs, dust and spot clean kitchenette surfaces and bench top, wipe down taps, clean sink, clean top and front of fridge, clean inside and outside of microwave, vacuum floor, mop floor, leave sink and bench top dry. Additional $10 charged if excessive cleaning required inside microwave.
  • xxiv. Kitchens (Commercial) – refers to standard cleaning with the following tasks for kitchens up to 15 square meters; remove cobwebs, dust and spot clean kitchen surfaces and bench top, wipe down taps, clean kitchen sink, clean around stove top, clean top and front of fridge, clean inside and outside of microwave, vacuum floor, mop floor, leave sink and bench top dry. Additional $10 charged if excessive cleaning required inside microwave.
  • xxv. Lavatory – refers to standard cleaning of lavatory/cubicle areas up to 2.1 square meters; remove all cobwebs, dust and spot clean surfaces and window sills, clean mirrors (if any), scrub toilet bowl, wipe exterior surfaces of toilet bowl, vacuum floor (if required), mop floor.
  • xxvi. Sink – refers to standard cleaning of a hand basin and tap/s and any mirror located next to the sink.
  • xxvii. Shower – refers to standard cleaning of shower area; wipe down (scrub where needed) shower floor, shower door and all taps and fixtures in shower area.
  • xxviii. Desk/Table – refers to only wiping part of the desk or table that does not have belongings or equipment on it. Items will not be picked up to clean under.
  • xxix. Stairway – refers to standard cleaning for a single story stairway of up to 18 square meters; remove cobwebs, dust and spot clean surfaces and window sills, clean mirrors (if any), vacuum floor, mop floor (if required).
  • xxx. Lift – refers to standard cleaning of the inside of a lift up to 2.5 square meters; remove cobwebs, dust and spot clean surfaces, clean mirrors (if any), vacuum floor, mop floor (if required)
  • xxxi. Empty Waste Bin – refers to emptying all designated rubbish/waste bins into a larger rubbish bag for removal from premises. Replacing bags in rubbish/waste bins will incur extra charges.
  • xxxii. Rubbish Removal – refers to removing all designated rubbish in large rubbish bags from the premises. It does not include emptying all designated rubbish/waste bins. Neat Freaks may at their own discretion refuse to take away any rubbish which they deem not practical/possible to dispose, hazardous to staff, or requires special measures for collection and/or disposing.
  • xxxiii. Function Clean – refers to excessive cleaning of the same area covered in regular cleaning to remove extra rubbish, wiping off higher than usual number of stains, marks and spills after meetings, conferences, functions or staff parties/celebrations and consequently requires additional time to complete the cleaning or requires extra personnel to clean within the regular time frame. If prior notification not given for Function Clean, Neat Freaks may at their own discretion charge Function Clean.

10.Limited Services in Areas with Parking Restrictions

Unless off-street parking is provided by the customer in areas having parking restrictions, regular cleaning services will only be provided for a maximum of 105 minutes and we may at our discretion not provide a full range of services to the address provided. This is not applicable to Deep Cleaning Services.

11.Property Access

Residential Services:

  • i. By using our Service/s, you agree to provide us with access to your property and consent to us entering and working inside, outside or around your property for the provision of our Service/s. This may include being at the property when we call, leaving out a key for us, providing a key for our use, access code or access card to gain access to your property.
  • ii. We do not recommend leaving out a key for us, whether in a secure lockbox or otherwise, to give us access to your property. You agree not to hold Neat Freaks or any representative of Neat Freaks responsible for any loss or damage to any key, lockbox or any other device left out for us to gain access to your property.
  • iii. If we are unable to access your property for reasons outside our control, you will still be charged for the scheduled Service/s and consent to us doing so.
  • iv. If you provide a key or access card to us for the purpose of gaining access to your property and subsequently cancel our Service/s, we will follow all legal responsibilities to return such property of yours back to you.

Commercial Services:

  • i. By using our Service/s, you agree to provide us with two copies of a key or access card to grant entry/access to your property and consent to us entering and working inside, outside or around your property for the provision of our Service/s.
  • ii. We are unable to offer a high standard of Service/s if not provided with a second key/access card to carry out quality control checks.
  • iii. We do not recommend leaving out a key for us, whether in a secure lockbox or otherwise, to give us access to your property. You agree not to hold Neat Freaks or any representative of Neat Freaks responsible for any loss or damage to any key, lockbox or any other device left out for us to gain access to your property.
  • iv. If we are unable to access your property for reasons outside our control, you will still be charged for the scheduled Service/s and consent to us doing so.
  • v. If you provide a key or access card to us for the purpose of gaining access to your property and subsequently cancel our Service/s, we will follow all legal responsibilities to return such property of yours back to you.

11.Messaging

When requesting for any Company Service, the Company may need to send you SMS or Push Messages in order to confirm your phone number or keep you informed about the Services we may be performing for you. Some of these messages may be necessary for the fulfilment of the Service and cannot be avoided or opt-ed out of. Depending on your mobile service provider, you may incur Fees for these SMS or Push Messages, and you agree the Company will not be liable for any such Fees.

12.Feedback

You may choose to provide the Company with feedback regarding the features and performance of the Service, including reports of failures, errors or standard of quality of the Service (the “Feedback”). Feedback provided to the Company may be used to improve the Service for you or for others, and accordingly, you hereby grant the Company a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sublicense, distribute, modify and otherwise exploit such Feedback without restriction.

13.Privacy Policy

When you register for, request for or use our Service, we collect personal data in order to communicate with you and accurately provide our Services. We DO NOT share your personal data with anyone except people directly involved in providing you with our Services, people overseeing quality control and people managing customer services and people managing feedback received by the Company or where required by law to hand over such details to third parties. By using our Service you consent to us using your personal data according to our Privacy Policy.

14.Modification of Terms

We may, from time to time, post notices on the Site for your attention or email these to the address we have for you. All notices are effective upon posting or when sent. Additionally, we may change the Terms of Service at any time by posting the modified version on the Site or by sending you a copy by email. Please refer to the Terms and Conditions on the Site periodically for any such changes. By continuing to access or use the Service after we have posted or emailed any such changes, you agree to abide by the modified Terms of Service, but only on a going forward basis.

15.Company Property

Your rights with respect to our Service are limited to those rights explicitly granted in the Terms of Service. You acknowledge and agree that the Company owns all rights, title, and interest in and to the Service, including all intellectual property rights therein, even if the Company incorporates any materials provided or made available by you into subsequent versions of the Service.
Except as explicitly permitted in the Terms of Service, you may not reproduce, modify, distribute, sell, transfer, publicly display, publicly perform, transmit, or otherwise use or exploit any portion of the Service, including without limitation any information provided through the Service. The content of the Service includes copyrighted materials, trademarks, trade secrets, and other proprietary information, which may include, without limitation, text, software, photos, video, audio visual recordings, graphics, music and sound. The entire contents of the Service and subsets thereof are also protected by copyright as collective works. The Company owns a copyright in the selection, coordination, arrangement, and enhancement of such content, as well as in the content original to the Company. You may not create a database or other archival collection in electronic or physical form by downloading and storing, transcribing, or otherwise utilizing by any manual or automated means, any materials associated with the Service.

16.Prohibitions

You agree not to do or attempt (or request that any third party do or attempt) any of the following during or in connection with your (or their) use of the Service:

  • i. send unsolicited email, bulk email, junk mail, spam or chain letters, or promotions or advertisements for products or Services, including without limitation those which are designed to promote, directly or indirectly, a product or Service with which you have a business relationship or other commercial connection;
  • ii. impersonate or misrepresent your affiliation with, or your lack of affiliation with, any person or entity;
  • iii. use the Service in violation of the Company’s or any third party’s intellectual property or other proprietary or legal rights;
  • iv. use the Service in violation of any applicable law or request that Service personnel provide a Service which would violate applicable law; or

17.Termination of Use; Discontinuation and Modification of the Service

If you violate any of the Terms of Service, your permission to use the Service will terminate automatically. You also agree that we may, at any time and without notice to you, suspend or revoke your access to and use of the Service:

  • i. for any or no reason at all;
  • ii. where determined by the sole discretion of Neat Freaks that such action is reasonable in order to comply with legal requirements or to protect the rights or interests of the Company; or
  • iii. in connection with any general discontinuation of the Service. We also reserve the right to modify the Service at any time without notice to you. We will have no liability whatsoever on account of any change to the Service or any suspension or revocation of your access to or use of the Service. You may terminate this agreement and any on-going Services at any time by contacting customer service at info@neatfreaks.co.nz.

18.Indemnity

You agree that you will be personally responsible for your use of our Service, and you agree to defend, indemnify and hold harmless the Company and its officers, directors, employees, consultants, affiliates, subsidiaries and agents (collectively, the Company Entities) from and against any and all claims, liabilities, damages, losses and expenses, including reasonable solicitors’ and accounting fees and costs, arising out of or in any way connected with

  • i. access to, use of or alleged use of the Service;
  • ii. violation of the Terms of Service or any representation, warranty, or agreements referenced herein;
  • iii. violation of any third party right, including without limitation any intellectual property right, publicity, confidentiality, property or privacy right;
  • iv. any disputes or issues between you and any third party. We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defence of such claim. You will not, in any event, settle any claim or matter without our written consent.

19.Use of the Service Is Entirely at Your Risk

You expressly understand and agree that your use of the Service is at your own risk and that the Service is provided “as is” and “as available”. Neat Freaks expressly excludes all warranties and conditions, (whether implied by statute, common law or otherwise and including any warranty as to fitness for purpose and satisfactory quality, and non-infringement) to the maximum extent as allowed by law.

20.Limitation of Liability and Release

To the extent permitted by applicable law, Neat Freaks disclaims all liability to you in connection with performance under these Terms and Conditions, including but not limited to liability for loss of profits and other consequential losses. Except in the case of death or personal injury caused by the Company’s negligence, the liability of the Company under or in connection with these Terms and Conditions whether arising in contract, tort, negligence, breach of statutory duty or otherwise howsoever shall not exceed the Fees paid by you to the Company in the last three months under these Terms and Conditions. Neither Party shall be liable to the other Party in contract, tort, negligence, breach of statutory duty nor otherwise for any loss, damage, costs or expenses of any nature whatsoever incurred or suffered by that other Party of an indirect or consequential nature including without limitation any economic loss or other loss of turnover, profits, business or goodwill. The limitations of damages set forth above are fundamental elements of the basis of the bargain between Neat Freaks and you.

21.Applicable Laws

These Terms, whether interpreted in a court of law or in arbitration, shall be governed by the law as applicable in New Zealand law as they apply to agreements entered into and to be performed entirely within New Zealand by residents of New Zealand, and without regard to conflict of law principles. To the extent that any lawsuit or court proceeding is permitted hereunder, you and Neat Freaks agree to submit to the personal and exclusive jurisdiction of the courts located within New Zealand for the purpose of litigating all such claims and disputes.

22.General

The Terms of Service consist of the entire agreement and exclusive understanding between you and the Company regarding your use of and access to our Service, and except as expressly permitted above may only be amended by a written agreement signed by authorized representatives of the parties. You may not assign or transfer the Terms of Service or your rights under this contractual agreement, in whole or in part, by operation of law or otherwise, without prior written consent from us. We may assign the Terms of Service at any time without notice. Use of numbered headers in the Terms and Conditions is for convenience only and shall not have any impact on the interpretation of particular provisions. In the event that any part of the Terms of Service is held to be invalid or unenforceable, the unenforceable part shall be given effect to the greatest extent possible and the remaining parts will remain in full force and effect.

23.Liability

Our liability to you in respect of the Service/s provided will not exceed the total price paid by you for our Service/s, whether such cause of action is brought in contract, tort, warranty or otherwise. Notwithstanding the above, nothing in these Terms and Conditions shall limit any rights you might have as a consumer or other statutory rights that are not excluded by law, nor exclude or limit our liability to you for any death or personal injury resulting from our negligence.

24.Events Beyond Our Control

We shall have no liability to you for any failure to perform Service/s that you have requested, or any delay in doing so that may be caused by an event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems, flood, fire, explosion, acts of terrorism, natural disasters or accidents.

25.Miscellaneous

  • i. Invalidity: If any individual terms of these Terms and Conditions are determined to be invalid, void or unenforceable for any reason, they will be separated and cut off from the rest of the Terms and Conditions. All other terms shall not be affected and remain valid.
  • ii. Privacy: When you request our Service/s, we collect certain personal and information (e.g. name, address, email address). We only use this information to contact you and provide you with our Service/s.
  • iii. Entire Agreement: These Terms and Conditions set out the whole of our agreement relating to your use of the Neat Freaks Site and the provision of Services requested by you from Neat Freaks..
  • iv. Third Parties: Except for our affiliates, directors, employees or representatives, a person who is not party to the contract shall have no rights under the Contracts (Rights of Third Parties) Act 1999 (“Act”) to enforce any term of the contract. This does not affect any right or remedy of any person which may exist or is available otherwise than pursuant to that Act.
